Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the mobile application and related services provided by BouncySpark.com (“BouncySpark,” “we,” “us,” or “our”) (collectively, “our application” or the “Service”).
Please read these Terms carefully before using the Service.
1. Acceptance of these Terms
By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the Service.
You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
We may update these Terms from time to time. Material changes will be posted at https://bouncyspark.com/terms with an updated effective date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
2. Description of the Service
BouncySpark provides a consumer financial application that helps you:
- Track portfolios, holdings, and related financial information
- Organize assets and custom entries you choose to add
- Link bank and investment accounts through Plaid when you authorize a connection
- Receive in-app and push notifications related to the Service
The Service is designed for personal portfolio tracking and informational purposes. Features may change, be added, or be removed over time. We do not guarantee that any particular feature will remain available.
When you link a financial institution, you interact with Plaid Link, operated by Plaid Inc. Plaid’s terms and privacy disclosures apply to that linking process. We receive only the account and financial data you authorize through Plaid, as described in our Privacy Policy.
3. Account registration and authentication
3.1 Phone-based sign-in
To use the Service, you must create an account using your phone number as your primary identifier. We send a one-time passcode (OTP) by SMS to verify your number. You are responsible for maintaining access to that phone number and for any activity that occurs under your account.
3.2 Optional two-factor authentication
You may optionally enable time-based one-time passwords (TOTP) using an authenticator app for additional protection when signing in.
3.3 Account security
You agree to:
- Provide accurate account information and keep it up to date
- Keep your sign-in credentials and devices secure
- Notify us promptly at security@bouncyspark.com if you suspect unauthorized access to your account
We are not liable for losses arising from unauthorized use of your account where you have failed to safeguard your credentials or devices, except where prohibited by law.
3.4 One account per person
You may not create multiple accounts to evade restrictions, abuse the Service, or impersonate others.
4. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

We may investigate suspected violations and cooperate with law enforcement where required. We may suspend or terminate access for conduct we reasonably believe violates these Terms or poses risk to the Service or others.
5. Financial account linking (Plaid)
Linking a financial institution is optional and requires your explicit authorization through Plaid. By initiating a link, you represent that you are authorized to connect that account and that the information you provide is accurate.
You may disconnect linked institutions in the app at any time. Disconnecting stops new data collection from that institution, subject to our Privacy Policy and data retention practices.
BouncySpark is not a party to your agreements with your financial institutions. We do not control what data institutions make available through Plaid.
6. Intellectual property
6.1 Our rights
The Service, including its software, design, text, graphics, logos, and other content (excluding content you provide), is owned by BouncySpark or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use in accordance with these Terms.
6.2 Your content
You retain ownership of information you submit to the Service (such as portfolio labels, custom assets, and profile details). You grant us a license to use, store, display, and process that information solely to operate, improve, and secure the Service as described in our Privacy Policy.
6.3 Feedback
If you provide suggestions or feedback, you grant us the right to use it without restriction or compensation to you.
6.4 Restrictions
You may not copy, modify, distribute, sell, or lease any part of the Service or reverse engineer it except where applicable law expressly permits.
7. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, BOUNCYSPARK DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7.1 Not a bank, broker, or financial advisor
BouncySpark is not a bank, credit union, broker-dealer, investment adviser, or tax professional. We do not:
- Hold deposits, extend credit, or provide banking services
- Execute trades or transmit funds on your behalf
- Provide personalized investment, legal, or tax advice
Information displayed in the Service—including balances, holdings, quotes, and aggregations—is for informational and organizational purposes only. It may be delayed, incomplete, or inaccurate. You are solely responsible for your financial decisions and should consult qualified professionals before making investment or tax decisions.
7.2 Third-party data and services
Market data, institution data, and linked account information may come from third parties (including Plaid and data providers). We do not guarantee the accuracy, completeness, or timeliness of third-party data.
7.3 No guarantee of availability
We do not warrant that the Service will be uninterrupted, error-free, or secure. Maintenance, outages, and third-party failures may affect availability.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
- BOUNCYSPARK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.
- OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud or willful misconduct.
9. Indemnification
You agree to defend, indemnify, and hold harmless BouncySpark and its officers, directors, employees, and affiliates from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
10. Termination
10.1 By you
You may stop using the Service at any time. You may delete your account through in-app settings (when available) or by contacting security@bouncyspark.com.
10.2 By us
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, pose a security or legal risk, or if we discontinue the Service. Where practicable, we will provide notice before termination.
10.3 Effect of termination
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute provisions) will survive termination.
We will handle your data after termination as described in our Privacy Policy and Data Retention and Deletion Policy.
11. Governing law and disputes
These Terms are governed by the laws of the United States and the state in which BouncySpark is organized, without regard to conflict-of-law principles.
Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in that state, and you consent to their personal jurisdiction, except where applicable law requires a different forum.
Before filing a claim, you agree to contact us at security@bouncyspark.com and attempt to resolve the dispute informally.
